FAQs


1. Which factory needs to take licence under Factories Act, 1948?
A.

Factories Act, 1948 and A.P. Factories Rules 1950 there under are applicable to any premises where:

  1. i. Ten or more workers are working or were working on any day of the preceding twelve months and in any part of which a manufacturing process is being carried on with the aid of power or is so ordinarily carried on.
  2. ii. Twenty or more workers are working or were working on any day of the preceding twelve months and in any part of which manufacturing process is being carried on without aid of power or is ordinarily so carried on
  3. iii. All the premises declared as a "Factory" by the State Government by notification under Section 85 of the Factories Act, 1948 in the Official Gazette.

2. Is the licence fee payment for the calendar year or financial year?
A.

The licence fee payment is for the calendar year

3. When does a licence requires to be amended?
A.

The licence requires to be amended when there is a change in the:

  1. i. Maximum horse power installed.
  2. ii. Maximum number of workers.
  3. iii. Change in name of the factory .

4. Are the Returns to be filed with the Inspector of Factories?
A.

The Annual Return shall be sent to the Inspector of Factories on or before 31st January

5. What are the responsibilities of Occupier?
A.

Every occupier shall ensure, so far as is reasonably practicable, the Health, Safety and Welfare of all workers while they are at work in the factory as detailed in Section 7 - A (General duties of the Occupier)

6. What are the obligation of workers?
A.

No worker in a Factory -

  1. Shall wilfully interfere with or misuse any appliance, convenience or other thing provided in a factory for the purposes of securing the Health, Safety or Welfare of the workers therein..
  2. Shall wilfully and without reasonable cause do anything likely to endanger himself or others and
  3. Shall wilfully neglect to make use of any appliance or other thing provided in the factory for the purposes of securing the health or safety of the workers therein.

7. Whether Factories Act is applicable to Government Factories also?
A.

Factories Act is applicable to all the factories including factories under the control of Central Government and State Government.
